1. Provider Agreement
This Provider Agreement governs the relationship between Bookedtify and any service provider, business, professional, freelancer, team member, or organisation that creates a provider account, lists services, accepts bookings, receives payments, or otherwise uses provider tools through Bookedtify.
This Provider Agreement forms part of the Bookedtify legal terms and should be read together with the Terms of Service, Privacy Policy, Refund and Cancellation Policy, Cookie Policy, and any subscription, billing, payment, or Stripe terms that apply.
2. What Bookedtify Provides
Bookedtify provides software, booking tools, marketplace features, provider dashboards, calendar tools, payment-related tools, client communication tools, visibility features, and related platform services.
- Providers can create public profiles and list services.
- Providers can display prices, descriptions, duration, availability, and policies.
- Providers can receive, accept, reject, reschedule, or cancel bookings.
- Providers can manage calendars, teams, payments, subscriptions, and booking history.
3. Independent Provider Status
The provider-client service contract is formed directly between the provider and the client. Bookedtify is not a party to that service contract and does not provide the actual listed services.
Providers are independent businesses, professionals, freelancers, contractors, or organisations. Nothing in this Provider Agreement creates an employment, agency, partnership, joint venture, franchise, or representative relationship between Bookedtify and the provider.
4. Eligibility and Warranties
To use Bookedtify as a provider, you must be legally capable of entering into a binding agreement, be at least 18 years old or the legal age required in your country, provide accurate information, have the legal right to offer listed services, and hold all required licences, registrations, permissions, qualifications, insurance, and professional approvals.
By using Bookedtify, providers warrant that listed services are legal and safe, information is accurate, applicable laws are followed, clients are not misled, bookings are honoured unless cancellation is permitted, client data is used only for legitimate purposes, platform fees are not bypassed, and Bookedtify investigations are supported.
5. Profiles, Listings, Pricing, and Taxes
Providers are responsible for the accuracy of profiles and service listings, including service description, price, duration, location, availability, cancellation rules, refund rules, preparation requirements, age restrictions, and any health, safety, licensing, or suitability requirements.
Providers are responsible for setting their own service prices unless Bookedtify provides a specific pricing structure for a particular feature, promotion, or plan. Hidden fees must not be added after booking unless clearly disclosed before the client booked.
Providers are solely responsible for determining, collecting, reporting, and paying all taxes related to their services and income.
6. Bookings and Cancellations
Providers are responsible for checking booking details before accepting or confirming a booking, keeping availability accurate, and not accepting bookings they cannot reasonably fulfil.
Providers should cancel confirmed bookings only where necessary. Provider cancellations may lead to refunds, deductions, payment processing costs, dispute or chargeback responsibility, reduced visibility, account review, suspension, or termination for repeated cancellations.
Client cancellation rights depend on the cancellation policy shown at the time of booking, mandatory consumer rights, and applicable law.
7. Refunds, Payments, Payouts, and Reserves
Providers are responsible for refunds owed to clients because of provider cancellation, provider no-show, failure to deliver the service, misleading descriptions, unsafe or illegal service, duplicate payment, overcharge, client rights under applicable law, or other provider-caused issues.
Bookedtify may use third-party payment providers, such as Stripe, to process client payments, provider payouts, subscriptions, platform fees, refunds, disputes, chargebacks, invoices, receipts, and tax-related records.
Bookedtify may apply payout delays, transaction-level holds, account-level holds, rolling reserves, risk reserves, payout suspension, partial withholding, refund reserves, or chargeback reserves where reasonably necessary.
8. Chargebacks, Evidence, and Negative Balances
Providers are financially responsible for chargebacks, disputes, and related fees arising from provider cancellation, no-show, non-performance, misleading listings, unauthorised or disputed charges caused by provider conduct, client dissatisfaction caused by provider service, refund refusal where a refund was due, provider fraud, negligence, misconduct, or illegal activity.
Providers must keep accurate records of bookings, attendance, communications, service delivery, cancellations, refund decisions, client complaints, and dispute evidence, and must provide evidence promptly when requested.
If refunds, disputes, chargebacks, fees, reversals, or deductions create a negative provider balance, the provider must repay the negative balance immediately.
9. Client Data and Sensitive Information
Providers may receive client personal data through Bookedtify only for managing bookings and delivering the booked service. Providers must process client data lawfully, fairly, securely, and only for legitimate purposes.
Providers must not sell client data, share it with unauthorised third parties, use it for unrelated marketing without permission, contact clients for unrelated purposes, scrape or export client data for unrelated use, request unnecessary personal data, or misuse sensitive information.
10. Communication, Anti-Circumvention, Reviews, and Ranking
Providers must communicate professionally, respectfully, and lawfully. Providers must not harass, threaten, spam, pressure clients, move platform-originated bookings outside Bookedtify to avoid fees, or ask clients to pay outside Bookedtify where platform payment is required.
Providers must not manipulate reviews, buy reviews, post fake reviews, pressure clients for positive reviews, or punish clients for honest reviews.
Bookedtify may rank, recommend, filter, display, promote, or reduce visibility of provider profiles and services based on relevance, category, location, availability, price, reviews, rating, booking history, response time, cancellation rate, dispute history, subscription plan, paid visibility where disclosed, compliance history, safety risk, and platform performance.
11. Moderation, Enforcement, and Appeals
Bookedtify may moderate provider profiles, listings, photos, reviews, messages, bookings, payouts, and account access. Enforcement may include warnings, listing edit requests, listing removal, reduced visibility, temporary booking restriction, payout hold, reserve requirement, refund deduction, suspension, termination, or reporting to authorities where required or appropriate.
Where required by applicable law, Bookedtify will provide a statement of reasons for major enforcement actions and may allow an appeal through the contact or appeal channel.
12. Subscriptions, Intellectual Property, Liability, and Closure
Bookedtify may offer free and paid provider plans with feature limits, commission differences, visibility features, team management, advanced tools, custom shop design, analytics, or other premium features.
Bookedtify owns or licenses all rights in the platform, software, design, logo, branding, code, databases, user interface, provider tools, analytics tools, and related materials.
To the fullest extent permitted by law, Bookedtify is not liable for provider service quality, safety, legality, cancellations, no-shows, client behaviour, payment provider actions, reduced ranking or visibility, lack of bookings, technical interruptions, third-party failures, or indirect damages.
Account closure does not cancel outstanding bookings, refund obligations, chargeback obligations, negative balances, tax obligations, legal obligations, data retention obligations, amounts owed to Bookedtify, or obligations that by their nature should survive.
